Welcome to Nord. These Terms and Conditions ("Terms and Conditions", or "Terms") describe the rules and regulations of Nord Scents ("Nord", "we", "us", or "our") governing the use of our website, services, and the purchase of our products.

2. Product Information and Usage

2.1 Product Description
Nord Solid Perfumes are refillable fragrance balms housed in refillable metal cases. While we provide detailed scent profiles, the actual fragrance perception, projection, sillage and longevity may vary based on individual skin chemistry and environmental factors. Based on standard usage, each scent pod (refill) lasts approximately 3 to 5 months; however, the actual duration depends on the frequency and volume of application.

2.2 Product Variability
Due to the nature of the ingredients used, slight variations in fragrance strength, texture, or appearance may occur across batches. These variations are normal and do not impact the quality or effectiveness of the product.

2.3 Proper Usage
Nord Solid Perfumes are for external, topical use only. Do not ingest. Avoid application on open wounds, irritated areas, or mucous membranes. In case of contact with eyes, rinse thoroughly with water. Keep out of reach of children and pets. If irritation occurs, discontinue use.

2.4 Allergies and Skin Sensitivity
Customers are responsible for reviewing the full ingredient list, available on our packaging and website, prior to use to identify any potential personal allergens. We strongly recommend performing a patch test on a small area of skin before regular application to ensure compatibility. Nord is not liable for any allergic reactions, skin sensitivities, or adverse effects resulting from the use of our products. If you have a known history of sensitive skin or specific allergies, please consult a healthcare professional before use. Should any irritation occur, discontinue use immediately.

2.5 Storage Instructions
To maintain the quality and longevity of Nord Solid Perfumes, store them in a cool, dry place away from direct sunlight and extreme temperatures.

2.6 Patch Testing
Before full use, customers are encouraged to perform a patch test by applying a small amount of the balm on a discreet area of the skin to check for any adverse reactions.

2.7 Expiration and Freshness
While Nord Solid Perfumes are made with durable ingredients, we recommend using the product within 12 months after opening for optimal scent and performance. The production date is indicated on the packaging for reference. Use of the product beyond 12 months is at your own risk.

2.8 Heat and Temperature Warnings
Avoid exposing the balm to temperatures above 25°C (77°F), as this may affect the consistency of the product. If melting occurs, allow the balm to cool and solidify naturally in a controlled environment before use.

2.9 Sharing Disclaimer
For hygiene reasons, Nord Solid Perfumes are intended for use by a single individual. Sharing the product may introduce contaminants or compromise the quality of the balm.

3. Ordering and Payment

3.1 Order Process
When placing an order, you agree that you are authorized to use the payment method provided. Once an order is placed, you will receive an email confirmation.

3.2 Pricing and Availability
Prices and availability of products are subject to change without notice. Prices displayed on the website are inclusive of applicable taxes (within the European Union) but exclusive of possible shipping fees. For orders shipped outside the EU (European Union), customers may be responsible for import duties, taxes, and customs fees. Nord is not liable for additional charges incurred during the import process.

3.3 Payment Methods
We accept various forms of payment, including major credit cards, PayPal, and iDeal. By submitting payment information, you authorize Nord to charge the stated amount.

3.4 Order Cancellations and Modifications
To ensure fast delivery, orders are processed shortly after they are placed. Consequently, orders cannot be modified once they have been processed. If you need to cancel your order, please contact us immediately. While we will make every effort to assist you, we cannot guarantee that your request will be seen or processed before the order enters the fulfillment or shipment stages. Once an order is in processing or has been shipped, cancellation is no longer possible.

3.5 Shipping and Delivery
Nord offers various shipping options, which are displayed at checkout. Estimated delivery times are provided as guidelines and may vary due to external factors such as customs clearance or carrier delays. Nord is not responsible for delays caused by shipping providers.

3.6 Pre-Orders
For products available for pre-order, full payment is required at the time of placing the order. Estimated delivery dates for pre-orders are subject to change, and updates will be communicated via email.

3.7 Fraud Prevention
Nord reserves the right to cancel orders flagged for suspicious or fraudulent activity. Customers may be required to provide additional verification for high-value transactions or unusual purchase patterns.

3.8 Payment Security
All payment transactions are processed through secure payment gateways. Nord does not store customer payment details.

3.9 Failed Payments
If a payment fails or is declined, the order will not be processed. Customers are advised to verify payment details or contact their payment provider for assistance.

4. Shipping, Delivery, and Risk of Loss

4.1 Shipping Destinations and Rates
We offer shipping globally through select carriers. Shipping rates are calculated at checkout and depend on the destination.

4.2 Delivery Timeline
Orders are typically dispatched within 2 business days. Delivery times vary depending on location but generally fall within 1 - 14 business days after dispatch.

4.3 Customs, Duties, and Taxes
For international shipments (outside EU), customs duties and taxes may apply. Customers are responsible for these charges, which vary by destination country. If a customer choose to refuse the customs fee and the shipment is returned back to Nord, a shipping and handling fee will be deducted from the refund.

4.4 Risk of Loss
The risk of damage to and/or loss of products rests with Nord until the moment of delivery to the consumer or a representative designated in advance and made known to Nord, unless expressly agreed otherwise.

4.5 Delivery Issues and Delays
Nord is not responsible for delays caused by external carriers (e.g., DHL, FedEx) but will assist in resolving any issues that arise. Contact our customer service team if there is a delay or tracking issue with your order.

4.6 Unsuccessful Deliveries
If a delivery is unsuccessful due to an incorrect address provided by the customer or failure to receive the package, the customer may be responsible for additional shipping costs and handling fees for redelivery, as well as any costs incurred for returning the package to Nord.

4.7 Package Tracking
Once dispatched, customers will receive tracking details via email. Nord encourages customers to monitor their shipment to ensure a smooth delivery process.

4.8 Damage During Shipping
If an item arrives damaged, customers must report this to Nord within 48 hours of receiving the package. Nord will work with the shipping carrier and the customer to resolve the issue.

4.9 Shipping Promotions
Occasionally, Nord may offer free or discounted shipping promotions. Such offers are subject to terms, including minimum order values or specific regions, as outlined in the promotion details.

4.10 Force Majeure
Nord is not liable for delays or failures in shipping due to events beyond its reasonable control, such as natural disasters, pandemics, strikes, or governmental restrictions.

5. Returns, Refunds, and Exchanges

5.1 Return Policy
We accept returns on products, even after use, within 14 days of delivery. If you are not satisfied with your purchase, please contact us to initiate the return process. The product must be returned in its original packaging. When returning your entire order, everything must be included, including but not limited to gifts, samples, and marketing materials. Return shipping costs may apply unless the product was damaged or defective.

5.2 Refunds
If you exercise your right of withdrawal, we will refund the full order amount, without delay and in any case within 14 days of the day you notified us of your return. We may withhold the refund until we have received the products or until you have demonstrated that you have returned them. If the product is damaged due to use beyond what is necessary to establish its nature and characteristics, Nord may charge a reasonable reduction in value.

5.3 Exchanges
We offer exchanges if you would like to try a different scent or if an incorrect item was sent to you. To initiate an exchange, please contact customer service within 14 days of delivery. Products must be returned in their original packaging, and return shipping costs may apply unless there was an error with your order.

5.4 Damaged or Defective Items
If your product arrives damaged or defective, please contact us within 48 hours of delivery with proof of the damage (e.g., photos) and order number. Nord will work with the customer to resolve the issue.

5.5 Return Shipping Process
Customers are required to securely package items to prevent damage during return shipping. While using a trackable shipping service is not mandatory, we strongly recommend it to ensure the return reaches us safely and to guarantee that your return is processed without issues. Failure to securely package items may result in delays or rejection of the return.

5.6 Gift Returns
If you received a Nord product as a gift and would like to return or exchange it, please contact customer service. Refunds for gifts will be issued as store credit or to the original purchaser.

5.7 Refund Exceptions
Shipping costs, also for returns, are non-refundable unless the return is due to a Nord error, such as a defective product or incorrect item shipped.

5.8 Extended Return Period for Promotions
For purchases made during special promotions (e.g., holiday season), we may offer an extended return period. Details will be specified in the promotion terms and conditions.

5.9 Disputes
If a return, refund, or exchange request is disputed, Nord reserves the right to make the final decision based on the circumstances and evidence provided.

6. Limited Warranty and Liability

6.1 Limited Warranty
We warrant that the metal case is free from defects in material and workmanship under normal use. This warranty is valid for five (5) years from the date of purchase. The warranty applies solely to the case and excludes any damage caused by misuse, neglect, or accidents. Scratches, dents, and other signs of wear and tear resulting from normal use are not covered under this warranty.

6.2 Disclaimer of Warranties
Nord guarantees that the products comply with the agreement, the specifications stated in the offer, the reasonable requirements of soundness and/or usability, and the statutory provisions existing on the date the agreement was concluded. In addition to any commercial warranty, the consumer retains their statutory rights regarding non-conformity (legal guarantee) in full.

6.3 Limitation of Liability
Nord’s liability is limited to the amount of the order, except in cases of intent or deliberate recklessness. Nord excludes all liability for personal injury, except where such exclusion is prohibited by law.

6.4 Exclusions from Warranty
This warranty does not cover damages or defects caused by misuse, neglect, unauthorized modifications, improper storage, or external factors such as accidents, natural disasters, or exposure to extreme conditions.

6.5 Warranty Claims
To make a warranty claim, customers must provide proof of purchase and detailed evidence of the defect, such as photos or videos. Claims must be submitted within the 5-year warranty period from the date of purchase. Nord reserves the right to inspect the product and determine whether the defect is covered under the warranty.

6.6 Remedies for Warranty Claims
If a defect is confirmed under this warranty, Nord will, at its discretion, either repair or replace the product, or issue a refund. The remedy provided will be the sole and exclusive remedy under this warranty.

6.7 Jurisdiction and Governing Law
This limited warranty is governed by the laws of the Netherlands. Any disputes arising from this warranty will be resolved in accordance with Dutch law.

6.8 Product Safety and Liability
Nord is not liable for damages caused by the use of its products, including but not limited to physical damage, allergic reactions, or other adverse effects, whether resulting from incorrect use, failure to follow product instructions, or other circumstances beyond our control. Customers are responsible for using the products as intended and storing them in appropriate conditions.

6.9 Limitation of Duration
Any implied warranties that may not be disclaimed under applicable law are limited to the duration of the express warranty provided above (5 years from the date of purchase). The warranty is valid as long as the product remains part of our assortment.

7. Intellectual Property and Copyright

7.1 Ownership of Content
All content on the Nord website, including but not limited to product images, photos, CGI renders, logos, designs, and text, is the exclusive property of Nord and protected by intellectual property laws.

7.2 Restrictions
You may not reproduce, modify, distribute, display, or create derivative works of any content from our website without prior written permission from Nord.

7.3 Commercial Use Prohibition
Nord Solid Perfumes are intended for personal use only. Commercial redistribution or repackaging of the product without permission is strictly prohibited.

7.4 Trademarks
All trademarks, service marks, and logos used on the Nord website or in connection with our products are the exclusive property of Nord. Unauthorized use of these trademarks is strictly prohibited and may result in legal action.

7.5 License to Use Website
By accessing the Nord website, you are granted a limited, non-exclusive, and revocable license to use the website solely for personal, non-commercial purposes. This license does not transfer ownership of any intellectual property rights to you.

7.6 User-Generated Content
By submitting reviews or other content, you grant Nord a royalty-free, non-exclusive, and worldwide license to use, reproduce, and publish this content for marketing purposes. Intellectual property remains with the user.

7.7 Intellectual Property Violations
If you believe that your intellectual property rights have been violated on the Nord website, please contact us immediately with detailed information about the alleged infringement.

10.2 Dispute Resolution
in the event of a dispute, the parties agree to seek resolution amicably. If unresolved, the dispute shall be submitted to the exclusive jurisdiction of the courts of The Netherlands.

10.3 Mediation Option
Before initiating legal proceedings, the parties may agree to attempt mediation with a neutral third-party mediator in The Netherlands. Costs for mediation will be shared equally unless otherwise agreed.

10.4 Language of Proceedings
All dispute resolution proceedings, including mediation or court cases, will be conducted in Dutch or English, as mutually agreed by the parties.

10.5 Limitation Period
Any claim or cause of action arising out of or related to these Terms and Conditions must be filed within one (1) year after the claim arises, or it will be permanently barred, unless otherwise provided by applicable law.

10.6 Waiver of Class Actions
To the extent permitted by law, any disputes must be resolved on an individual basis. You agree not to bring a claim as a plaintiff or class member in any class, consolidated, or representative action.

10.7 Force Majeure
Nord will not be held liable for delays or failures in performance resulting from events beyond its reasonable control, including but not limited to acts of God, natural disasters, government actions, labor disputes, or technical failures.

Nord reserves the right to modify these Terms and Conditions at any time. Changes will be posted on this page, and by continuing to use our site after modifications, you agree to be bound by the revised Terms.
